ARTICLE 1 – PURPOSE OF THE CONTRACT
1.1 - General Information
These General Terms and Conditions of Sale (GTC) define the jet ski rental terms offered by Cannes Jet Ride Evasion, a simplified joint-stock company with a capital of €5,000, whose registered office is located at 29 avenue des Hespérides, 06400 Cannes, registered with the Cannes Trade and Companies Register under number 901 143 735. Any reservation implies unconditional acceptance of these GTC.
1.2 - Definitions
Customer: refers to the person who orders the service or gift voucher, either for themselves or for a third party, and who pays the price of the service. Also refers to the beneficiary of the service, whether they have paid for it or not.Service Provider: refers to the company Cannes Jet-Ride Evasion and its employees.Service: refers to the service provided by the service provider.Website: refers to the website https://cannesjetrideevasion.comARTICLE 2 – RENTAL CONDITIONS
2.1 - Access to Rental
The customer must be at least 16 years old.A physical boat license (coastal and/or river option) is required depending on the rental type. Depending on the country of origin, some boat licenses are not valid in France. In this case, the service provider has the right to refuse the service.A valid ID is required for all participants: drivers or passengers.For persons under 18 years of age, unaccompanied by their legal guardian, authorization from the legal guardian is required. This authorization must be handwritten, signed, and accompanied by a photocopy of the legal guardian's ID.Any person under 16 years of age will not be authorized to drive a jet ski and must be a passenger, provided they are in the presence of their legal guardian or have the latter's dated, signed written authorization (see previous point). To be a passenger, the minor must be able to touch their feet on the ground in the jet ski seat, have the strength and physical condition to do so. They must also give their consent to participate in the activity.The customer is booking a service included in a specific time slot. No service extensions or overflows will be granted.Therefore, the customer must IMPERATIVE: Arrive 30 minutes before the start of your session, otherwise the service will be canceled without refund. In some cases, the session may be maintained but shortened, without refund for the portion not completed.The service provider reserves the right to refuse a client whose behavior it deems inappropriate, without justification or refund.If a client presents a falsified identity document or falsified parental authorization, the service provider reserves the right to cancel the service without refund.Telephone or in-person reservations are mandatory and require a deposit (50% per jet booked).2.2 - Use of the jet ski
Use the jet ski in responsible person.Comply with the navigation rules and current maritime legislation.Comply with the safety instructions provided by the service provider.Comply with the instructions for using the area and the jet ski provided by the service provider.Any failure to comply with the instructions given by the service provider will result in immediate termination without refund of the session or the remaining portion.Any lack of respect or verbal or physical aggression towards the service provider, its employees, and its equipment will result in immediate termination without refund.It is strictly prohibited to:
Towing an object or a person.Participate in competitions.Navigate under the influence of alcohol or drugs.Carry more passengers than the authorized number.Moor or beach the jet ski.Approach within 300 meters of the coast and cetaceans (dolphins or others).To approach within 30 meters of yachts or other boats at anchor and within 100 meters of any vessel or moving craft.To remove safety equipment (life jacket, neoprene protective shorts) throughout the session until the final stop.When renting with a license, it is strictly forbidden to have a person without a license pilot the boat. The latter must remain a passenger behind the person with the license.ARTICLE 3 – PAYMENT TERMS
A 50% deposit per jet ski is required upon booking. Payment is possible via a payment link by text message or email or on-site at the time of booking. The balance is due on the day of the service.Payment accepted: credit card, cash, bank transfer.Any time exceeded will be charged according to the service provider's terms and conditions.ARTICLE 4 – DEPOSIT
A €1,000 deposit is required for the rental of a 130 horsepower jetski, with or without a license. This deposit can only be paid in the form of a bank imprint (physical bank card).A €1,500 deposit is required for the rental of a 170 horsepower jetski, with a license. This deposit can only be paid in the form of a bank imprint (physical bank card).A €2,000 deposit is required for the rental of a 230 horsepower jetski, with a license. This deposit can only be paid in the form of a bank imprint (physical bank card). physical).It covers damage to and loss of equipment, delays, capsizing, soiling, or expenses not covered by insurance.In the event of damage or suspected damage, the return of the deposit may be deferred until the situation is resolved.For customers and trainees without a license, by signing the introductory or excursion contract, they agree to pay the above deposit retrospectively at the end of their session if they have caused any damage to the equipment used.ARTICLE 5 – PICKUP & INVENTORY
The jet ski is returned in perfect working order and in compliance with regulations.The jet ski contains the fuel necessary to provide the service.Fuel is included in the price of the service.A visual inventory must be carried out by the customer themselves on both the outward and return journeys. If this is not the case, it is to confirm the perfect condition of the watercraft they are about to use.The customer must report any anomalies upon receipt.ARTICLE 6 – AUTHORIZED USERS
Only the person(s) designated in the contract and over 16 years of age may operate the jet ski.Subletting and lending are strictly prohibited.The service provider does not have the required authorizations and permits to accommodate people with physical or mental disabilities.For rentals with a license: the service provider may also refuse.ARTICLE 7 – CANCELLATION AND MODIFICATION
7.1 – By the customer:
+30 days before: full refund.Between 30 and 2 days: 50% refund.Less than 2 days: no refund.All reservations are due in full if they are not canceled or modified 48 hours in advance. The number of jet skis reserved and the requested rental duration must be honored by the customer in terms of schedule compliance (30 minutes before the session) and in financial terms, which implies that all jet skis reserved for the agreed duration must be paid in full if they have not been modified or canceled 48 hours before the session.In the event of a delay to the agreed schedule, the services are due in full. Any missing time due to the client's delay will be deducted from the session.In the event of total or partial cancellation of the reservation within less than 48 hours, the entire service is due.The date may be changed depending on the client's and the rental company's availability up to 2 days before the service.
7.2 – By the rental company:
In the event of technical unavailability or other impediment, the service provider may:
Offer another equivalent jetski.Offer another date or time slot.Cancel and refund without compensation.ARTICLE 8 – INSURANCE
The service provider is covered by insurance.The customer remains responsible for uncovered damage as well as in cases of negligence or failure to follow instructions.Customer personal belongings are not insured.ARTICLE 9 – CUSTOMER OBLIGATIONS
Must comply with current maritime regulations.Is solely responsible to the authorities in the event of an offense.Must return the jet ski in the same good condition as when it was picked up and clean.Must contact the service provider in the event of damage, incident, or delay during their session.Must ensure they have the sufficient competence, otherwise the service provider may refuse the rental.Must not be under the influence of alcohol, drugs, or medication.Must have 100% vision and hearing, as well as 100% of the faculties of all 4 limbs.Must be able to understand and speak French or English.ARTICLE 10 – DAMAGE AND INCIDENTS
Any incident must be reported immediately.In the event of serious damage, a written declaration is mandatory upon return.Failure to declare or take precautionary measures may void insurance coverage.ARTICLE 11 – RETURN OF THE JETSKI
The jetski must be returned at the agreed time and place.Any delay or return off-site will incur a fee (the company's hourly rental rate).A visual return inventory is mandatory.Fees may apply for cleaning, damage, or lack of fuel.ARTICLE 12 – LIABILITY
The service provider is not liable for improper use or violations.If the jetski is seized by the authorities, the customer must reimburse the full value of the vehicle.Any legal or administrative costs related to the customer's fault are their responsibility.ARTICLE 13 – PROHIBITED AREAS in the municipality of Cannes:
Areas within 300 meters of the shore (islands, coasts).Passage area between Pointe du Palm Beach and Sainte Marguerite Island.Area between Sainte Marguerite Island and Saint-Honorat Island (Lérins Islands).Area around the Bay of La Croisette.All ports in the Alpes-Maritimes.ARTICLE 14 – GIFT VOUCHERS
The gift voucher is sent in digital format by email.The gift voucher must be presented in printed format.The gift voucher is valid only once.The gift voucher has an expiration date: the summer season corresponding to the date of purchase.Telephone or in-person reservations are mandatory and require a deposit (50% per jet booked).No refunds will be issued if the gift voucher is not used within the time limit.The gift voucher entitles the customer to a service. Therefore, all the conditions mentioned in this document apply to this service.ARTICLE 15 – DATA PROTECTION
The data collected is used solely within the framework of the rental agreement, in accordance with the GDPR. You have the right to access, rectify, and delete it upon request.
ARTICLE 16 – DISPUTES
Any dispute will be subject to French law. In the absence of an amicable resolution, the courts of Cannes jurisdiction will be competent.
